Terms of Service
Rules and conditions governing the use of the FamFish 1.0 application and EleaFish web services.
1. General Information
These Terms of Service ('Terms') govern your access to and use of the FamFish mobile application ('FamFish 1.0') and the website https://eleafish.com. The service is provided by Andrzej Rybka, operating under the EleaFish brand (Contact: contact@eleafish.com).
2. Acceptance of Terms
By creating an account, downloading FamFish, or accessing our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use FamFish.
3. Account Requirements
To use FamFish, you must register an account using a valid email address and password via Supabase Auth. You agree to provide accurate, current, and complete information and to keep your credentials confidential. You are responsible for all activities occurring under your authenticated account.
4. Family Administrators and Minors
An adult family administrator must be at least 18 years of age. Minors may join an active family workspace only with the verifiable invitation and approval of the adult family administrator. Adult administrators are responsible for managing permissions, oversight, and invitations within their household workspace.
5. Family Invitations and Memberships
Family memberships are established through secure invitation links, temporary codes, or QR codes generated by the family administrator. Users must only share invitation codes with intended household members. Unauthorized distribution of family invite codes is prohibited.
6. User Responsibilities
You agree to use FamFish responsibly and in compliance with all applicable laws. You are solely responsible for ensuring that content uploaded to your family workspace (such as notes, messages, images, and expenses) does not infringe upon third-party rights or violate local laws.
7. Communication and User-Generated Content
FamFish provides family group chat and direct 1:1 messaging strictly within the active family workspace. You retain ownership of content you submit. By posting content within FamFish, you grant a limited, non-exclusive license solely to host, transmit, and display that content to your authorized family members as necessary to deliver the service under the EleaFish platform. Public or random chat is not supported.
8. Calendar, Tasks, Projects and Budgets
FamFish provides tools for scheduling calendar events, managing chores, tracking habits, and recording expenses. While FamFish assists in household organization, users remain responsible for their personal schedules, financial obligations, and budget management.
9. Health and Fitness Features
FamFish offers voluntary wellness tools, including hydration logging, habit streaks, and optional read-only integration with Android Health Connect. Health Connect access requires explicit user consent for each read permission. Data synchronized to FamFish is used solely for personal progress tracking and lifestyle motivation.
10. No Medical Advice Disclaimer
FAMFISH IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, CLINICAL DIAGNOSIS, TREATMENT, OR EMERGENCY SERVICES. Features such as hydration targets, step tracking, and habit streaks are for informational and organizational motivation only. Always consult a qualified healthcare professional regarding medical concerns.
11. AI-Assisted Features
FamFish includes optional AI-assisted tools, such as automated expense categorization from OCR-extracted receipt text. Extracted text is processed by configured remote AI services (e.g., Google Gemini, OpenAI). AI-generated suggestions are automated tools provided for convenience; users should review expense entries for accuracy.
12. Premium Subscriptions
FamFish may offer optional paid Premium subscription tiers providing expanded features. The exact availability, features, pricing, and billing terms of Premium are displayed in Google Play and within the application prior to purchase. Premium features are governed by these Terms and our Subscription Terms (/subscriptions).
13. Payments Processed Through Google Play
All in-app purchases and subscription payments are processed exclusively through Google Play In-App Billing. Payment terms, billing cycles, payment methods, and renewals are governed by the Google Play Terms of Service. We do not store or process your credit card or CVV details.
14. Gamification, Coins and XP
FamFish includes gamification elements such as virtual coins, experience points (XP), and collectible fish companions to motivate healthy habits and household chores.
Virtual coins, XP, and collectibles: (a) have no cash value; (b) cannot be exchanged or redeemed for real-world currency, goods, or financial compensation; (c) are not cryptocurrency, tokens, or financial instruments; and (d) are non-transferable outside the app.
15. Prohibited Use
You agree not to: (a) reverse-engineer, decompile, or extract source code from FamFish; (b) circumvent security measures or workspace isolation controls; (c) use automated bots or scrapers; (d) upload malicious code; or (e) harass, abuse, or harm other users.
16. Availability and Changes to the Service
We strive for continuous service availability but do not guarantee uninterrupted operation. We may update, enhance, modify, or temporarily suspend features for maintenance, security, or operational reasons with reasonable notice where feasible.
17. Account Suspension and Termination
We reserve the right to suspend or terminate accounts that engage in severe or repeated violations of these Terms, illegal conduct, or actions that compromise system security, following appropriate notice where legally required.
18. Account Deletion
You may delete your account at any time via the in-app path (Profile → Settings → Account & Security → Danger Zone → Delete Account). Deletion is subject to a 14-day cancellation grace period. Detailed information on data deletion and shared family history is available at /account-deletion.
19. Intellectual Property
All software code, visual designs, trademarks, brand names, character artwork (including Emi & Lili), and logos associated with EleaFish and FamFish are the intellectual property of Andrzej Rybka and licensors. No title or ownership is transferred to you.
20. Limitation of Liability
To the maximum extent permitted by applicable law, the service provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use FamFish.
21. Consumer Rights
Nothing in these Terms excludes, limits, or waives mandatory statutory rights that consumers hold under European Union consumer protection directives or applicable national law (including statutory warranty rights and statutory withdrawal rights for digital services).
22. Changes to Terms
We may modify these Terms from time to time. If we make material changes, we will notify you through the app or website. Continued use of FamFish after updated Terms take effect constitutes acceptance.
23. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Poland and the European Union, without prejudice to mandatory consumer protection laws in your country of habitual residence.
